I wish to have my child (and/or myself) participate in Yoga-Tastic 4 Kids Inc. suspension yoga class, program and/or event using the YogiGym® Suspension System. I hereby agree that the use of the YogiGym® Suspension System is voluntary and at our own risk. I understand that it involves a certain level of risk of injury, and that these risks and dangers exist while using the YogiGym® Suspension System. These risks may include physical and psychological injuries. As a condition of my child (and/or myself) using the YogiGym® Suspension system, I accept the risks of using the YogiGym® Suspension System equipment on behalf of my child (and/or myself) and expressly agree to forever discharge, waive and release Yoga-Tastic 4 Kids Inc., its owners, agents, management, insurers, landlords, consultants and employees from any and all claims, demands, injuries, damages, actions, or courses of action, for all acts of active or passive negligence on the part of YogiGym® Suspension System or Yoga-Tastic 4 Kids Inc. on account of physical injury, mental anguish, death and/or property damage arising from any mishap, accident, loss, damage or injury suffered by my child (and/or myself) or others resulting from, connected with or caused by my child’s (and/or myself) use of the YogiGym® Suspension System, including, but not limited to, any injury resulting from defects or failure of any equipment or devices used in such services, facilities, and/or athletic/health equipment.

I declare and affirm that my child (and/or myself) is in good medical and physical condition and that the use of the YogiGym® Suspension Sling does not pose any danger to my child’s health. I agree that my child (and/or myself) will not engage in behavior which may be hazardous, dangerous, or may interfere with the enjoyment of other persons participating in this program.

When participating in classes, programs and/or events involving any type of animal at the studio, I assume all expected and unexpected risks and responsibility regarding possible injury due to contact with an animal. I acknowledge the unpredictably of animal behavior, and wish to have my child (and/or myself) participate anyway despite possibility of, but not limited to, contracting disease, being bitten, scratched, mauled and/or any other form of injury sustained as a result of having contact with an animal.

If despite the signing of this Waiver and Assumption of all Risk, a lawsuit is brought against YogiGym® or Yoga-Tastic 4 Kids Inc., its owners, agents, management, insurers, landlords, consultants or employees, I agree to pay for any and all court costs and attorney’s fees incurred as a result of such litigation. I understand this waiver and release is a material part of the consideration for my child (and/or myself) being allowed to use the YogiGym® Suspension System and participate in the activities of Yoga-Tastic 4 Kids Inc. As such, this is a full and final release applying to all unknown and unanticipated damages arising out of my child’s (and/or myself) use of the YogiGym® Suspension System, as well as to those now known or disclosed, and the undersigned waives all rights or benefits which the undersigned now has or in the future may have. I, and my child, agree to abide by the policies of Yoga-Tastic 4 Kids Inc. and will not duplicate any portion of any programs or classes without the expressed written consent of Yoga-Tastic 4 Kids Inc.
